April 17 2012 - Privacy-enhancing TSPs: recipe for defeating or justifying lawful access legislation?

U.S. resident Nicholas Merrill recently announced his intention to launch a Telecommunications Service Provider (TSP) that would focus on protecting the privacy of its customers. In particular, Merrill envisions a TSP that would go to great lengths to shield customer information from law enforcement agencies through the use of decryption and refusals to provide information in the absence of a legal requirement to do so. This issue of PrivacyScan considers how Merrill's proposal is likely to factor into the never-ending debate over lawful access initiatives in Canada.
